The next step to choosing the property you wish to buy is the drafting, approval and signing of a preliminary contract. This contact is called ‘Compromesso’ and its signing represents the first stage of the conveyancing process in Italy. This is a contract which is usually prepared by your trusted estate agent. Both the buyer/s and by the vendor/s must sign it in each page. It ought to be said that the prelimary contract is a legally binding contract with penalties owed by the party that breaches the agreement. This is a very unlikely event, however, provided that you put yourself in good and professional hands. You should also make sure that the contract is drafted by someone you trust and that it has been translated into your language. A contract which you are unable to fully understand can be deemed legally void.
With the signing of the Compromesso the vendor commits to sell his/her property; the buyer commits to buy that very same property. The contract must identify the property uniquely; contain all the clauses agreed with the vendor; the intended date for completion; the agreed purchase price; the date for payment of the balance and any information relating to the purchase. At the signing of the Compromesso the Buyer will be asked to make a deposit, which a percentage of the agreed purchase price. These percentage can vary between 10% to 30% depending on what has been agreed by the parties.
The penalty in case of breach of agreement is as follows:
If sale of the property falls through because of a change of heart by the buyer, he loses the deposit paid.
If it is the vendor that decides not to go ahead with the sale than the buyer is due twice the deposit back.
So basically the percentage agreed as a deposit is equal to the sum that would be lost by the party that breaches the contract.

The second stage of the conveyancing in Italy is the Final Deed of Sale, or Rogito. The rogito is prepared by a notary public and must be signed by all involved parties in his office. If you are not fluent in Italian, the ‘rogito’ must also be translated into your language for it to be valid. The notary is responsible for carrying out all necessary searches on to make sure that there is no adverse entry to the sale of the property. He will ensure that there are no mortgage, bad debt or other impediment that could affect tour purchase.
The signing of the Deed coincides with the completion date. The notary is responsible for paying all the due taxes on behalf of the Buyer. He will also register the Rogito at the Property Registry office. Before the signing of the rogito we will advise you about all the purchase expenses. This list will include the various taxes, the notary fees and all the other payable professionals fees.
